Mediation

Mediation is the most common of TLH Consulting’s services and Thomas has conducted a number of discovery mediations in document-heavy cases. Tom comes to mediation with the understanding that the parties and their lawyers have a plan about how they want to resolve the case. “I work to understand the case and then I do whatever I can to help the parties achieve their goal.” During a mediation, Tom spends far more time listening than talking. It allows him to be well informed on the matter and to help all parties make moves towards understanding and settlement of the matter at hand. “My goal is to get the parties to a range of settlement opportunities.”

Arbitration

This is as close as one can get to a trial like setting as one can get in the ADR (Alternate Dispute Resolution) world. Tom’s approach to arbitration is to review documents and deposition transcripts and when appropriate rule on legal issues in advance of the hearing. Once the hearing is over, Tom works with the other arbitrators of the case to arrive at a decision. Once a decision is reached, Tom provides a written opinion laying out the decision and the reasons therefore.
